Development Authority Act


Jaipur Development Authority, a body constituted under Jaipur Development Authority Act 1982 (Act. 25) under the Department of Urban Development and Housing, Government of Rajasthan.

Delhi Development authority constituted under THE DELHI DEVELOPMENT ACT, 1957


Mumbai Metropolitan Region Development Authority (MMRDA) set up under the Mumbai Metropolitan Region Development Authority Act, 1974 under Government of Maharashtra
The Development Authority Acts provide for the creation of the City Development Authorities. In many cases these authorities are created by the merger and transformation of the existing City Improvement Trusts.

 The Development Authority Act gives powers to the Development Authorities:

        To prepare and implement development schemes, mainly residential, commercial, recreational areas etc. including on-site and off-site infrastructure.
        To provide for private development of residential area.
        To institute the necessary institutional set-up for performance of their functions.
        To levy development charges and betterment tax on the beneficiaries to recover the investment costs.
        To raise resources by other means and maintain a development fund.
        To make regulations and bye-laws and administer them to control the use and construction of buildings.
 Though their jurisdiction covers the whole of the local planning area, mostly their activities are concentrated in areas outside the municipal boundaries.
 
Constitution of authority under the act provides following objective and function to urban development authority
·         Preparation of master plan and zonal development plans
·         Modifications to the master plan and the zonal development plan
·         Development of lands

o   Declaration of development areas and development of land in those and other areas.
o   User of land and buildings in contravention of plans 
o   Provision of Physical and Social Infrastructure in the city

·         ACQUISITION AND DISPOSAL OF LAN

o   Compulsory acquisition of land
o   Compensation for compulsory acquisition of land
o   Power of Authority to develop land in non-development area

·         FINANCE, ACCOUNTS AND AUDIT

·         SUPPLEMENTAL AND MISCELLANEOUS PROVISIONS

o   Order of demolition of building
o   Power to stop development
o   Power to seal unauthorized development
o   Power of Authority to levy betterment charges
o   Power to make rules & regulations
o   Development & Control as per Master Plan
o   Providing houses at low cost to economically weaker section.
